2 Legal basis
Article 13 of Law of The People's Republic of China on Product Quality and article 2 of Rules on Production license of Industrial Products (Trial)

3 Conditions for Approval
(1) The products applied shall be covered by the business scope of the applicant;
(2) Product quality shall be in conformity with the current national standards or industrial standards or enterprise standards;
(3) Technical materials and process requirements shall be correct and complete;
(4) Applicant shall have production facilities, technological equipments and measuring and inspection means to ensure the product quality;
(5) Applicant shall have technical staffs, skilled workers and measuring and testing personnel to ensure normal activity and product quality;
(6) Complete and effective quality management system shall be implemented;
(7) Relevant requirements in laws, administrative regulations and national policies shall be fulfilled;
(8) Particular requirements of Implementation Rules on Production license (hereinafter referred to as Implementation Rules) for various kinds of products shall be fulfilled.

4 Quantity for Approval
No quantitative restriction. Any enterprise in conformity with Implementation Rules is eligible to obtain the license.

5 Implementing Organizations
Shanghai Municipal Bureau of Quality and Technical Supervision (detail functions in charged by Shanghai Office for License), General Administration of Quality Supervision, Inspection and Quarantine of the People's Republic of China (hereinafter referred to as AQSIQ)

6 Procedure
(1) Application and Acceptance:
a Application shall be submit to Shanghai Office for License, together with following materials:
a) Application for National Production License of Industrial Products (see Annex 1) in triplicate;
b) Copies of business license in triplicate;
c) Copies of origin production license (for enterprises replacing license) in triplicate;
d) Other documents required in Implementation Rules.
b Application materials shall be examined by Shanghai Office for License. The latter shall decide and notify, in writing, on whether or not accepting the application within 5 working days.
c For the examinations on enterprise production conditions organized by Examination Department, which commissioned by AQSIQ, , Shanghai Office for License shall forward relevant materials to Examination Department within 15 days from the date of a decision on acceptance of the application being made.
(2) Examination on Enterprises Production Conditions:
a Examination on enterprises production conditions shall be organized by Examination Department or Shanghai Office for License in accordance with Implementation Rules.
For examinations organized by Shanghai Office for License, the Office shall undertake the examination on the production conditions of the applicant within 60 days from the date of a decision on acceptance of the application being made;for examinations organized by Examination Department, the Department shall undertake the examination on the production condition of the applicant with 60 days from the date of receipt of the materials forwarded by Shanghai Office for License.
b Examination Department or Shanghai Office for license shall set up a examination plan and notify applicant in advance.
c On-site examination shall be undertaken by Examination Team in accordance with Implementation Rules.
d In case of the production condition failing to pass the examination, Shanghai Office for License shall notify the applicant in writing. The applicant may reapply after 60 days from the date of receiving the notice.
(3) Sampling and Inspection
a In case of the production condition of an enterprise passing the examination, the Examination Team shall pick and seal up samples at the same time of on-site examination.
b The enterprise shall send (mail) the samples to inspection body within 15 days from the date of the samples being sealed.
c Inspection body shall ensure the inspection activity in conformity with Implementation Rules and finish inspecting within prescribed time-limit.
d In case of the product quality failing to pass the inspection, Shanghai Office for License shall notify the applicant in writing. The applicant may reapply after 60 days from the date of receiving the notice.
(4) Approval and Issuance of License
a Application materials shall be forwarded to National License Examination Center after being examined and collected by Examination Department or Shanghai Office for License.
For examinations on production conditions organized by Shanghai Office for License, the Office shall collect materials and forward the list of qualified enterprises and relevant materials to Examination Department. The Department shall undertake selective examination and materials collection within 45 days from the date of receiving the materials forwarded by Shanghai Office for License, and send the list of qualified enterprises and relevant materials to National License Examination Center;for examinations on production conditions organized by Examination Department, the Department shall send the list of qualified enterprises and relevant materials to National License Examination Center within 30 days from the date of finishing examinations.
b National License Examination Center shall finish examination within 15 days from the date of receiving the list of qualified enterprises and relevant materials collected by Examination Department and report them to National Office for License.
c National Office for License shall finish examining and verifying the materials reported by National License Examination Center within 20 working days from the date of receiving such materials.
d In case license requirements are met, license shall be issued by AQSIQ. In case requirements are not met, writing notice will be send to the applicant .

7 Time limit
(1) In case of examinations on production conditions organized by Examination Department, technical examinations and product inspections can be finished within 135 days from the date of acceptance of application; examinations and verifications and license issuance can be finished within 20 working days.
(2) In case of examinations on production condition organized by Shanghai Office for License, technical examination and prosduct inspection can be finished within 135 days from the date of acceptance of application. Examinations and verifications and license issuance can be finished within 20 working days.

8 Publication of examination and approval
AQSIQ shall continually publish the lists of enterprises obtaining licenses and relevant information on the website of AQSIQ and China Quality Daily.

9 Fee
(1) Legal basis
a Rules on Production license of Industrial Products (Trial) (Issuance No. 54 (1984) of the State Council);

c Notice of Ministry of Finance and State Planning Commission on adjusting authorities in charge of fee charging items including examination fee for production license of industrial products, and etc. (Issuance No. 19 (2002) Financial General of Ministry of Finance and State Planning Commission)
(2) Scope
a Fee on Examination and Publication: Examination and publication fee on production license of industrial products shall be turned over to the state treasury and be managed by central fiscal budget.
b Inspection Fee: Inspection fee shall be turned over to central or local exchequer inspection bodies finance subordinate to . The expenditure shall be arranged and used in accordance with approved budget by relevant bodies.
(3) Charging Unit
a Fee on Examination and Publication: Examination fee is 2200 RMB per enterprise, and for the same examination an additional fee, accounting of 20% of the examination fee, shall be imposed in case of one more unit applied for license. In the spirit of economy, publication fee is imposed according to facts, accounting for 400 RMB per unit applied for license.
b Inspection Fee: Inspection body undertaking the inspection of production license of industrial products shall charge according to the national inspection charging standards.
