Metrology Certification for Products Inspection Bodies

2 Legal Basis
Article 22 of Metrology Law of The People's Republic of China: A product quality inspection agency which is to provide notarial data on the quality of products for society must be checked for its capability and reliability of metrological verification and testing by the metrological administrative department of a people's government at or above the provincial level.
Article 32 of Rules for the Implementation of The Metrology Law of the Peoples Republic of China: A product quality inspection agency which is to provide notarial data on the quality of products for society must be certified by the metrological administrative department of a people's government at or above the provincial level.
Article 27 of Shanghai Administrative Rules on Metrology Supervision: Agency which is to provide measurement data for society shall meet the requirements, regarding especially of equipments, personnel, system and environment, in national technical specifications of metrology and apply for metrology certification to Shanghai Bureau of Quality and Technical Supervision.

3 Conditions for Approval
For applicant, following basic conditions shall be met:
(1) Applicant holds the notarial position as a third party;
(2) Existing laws and regulations, national and international standards/rules and specifications, industrial standards, or local standards applicable to and as a basis of item applied shall be in place;
(3) Measuring capability shall meet the established requirements in national and international standards/rules and specifications, industrial standards, or local standards which are the basis of the item applied;
(4) Organization structure, personnel, sites (regular, temporary or ambulatory), measuring devices and quality assurance measures which meet the requirements of metrology certification shall be in place.
No authorization shall be granted unless the review on metrology certification is passed. Details of the review please see Shanghai Criteria of Review on Metrology Certification.

4 Implementing Organization
Shanghai Bureau of Quality and Technical Supervision

5 Procedure
(1) Application
The applicant shall apply for metrology certification to Shanghai Bureau of Quality and Technical Supervision and submit following application materials:
a Application for metrology certification in duplicate;
b Certificate on qualification of a legal person;
c Documentary evidence on the approving establishment of the organization by higher organization or relevant department;
d Quality manual;
e Category of procedural documents;
f Typical measuring reports of the applicant (about 1-2 reports for each major item);
g evidentiary materials proving participation of the applicant in capability verification activities (in last 2 years, and for application for the first time, such evidentiary material is not required);
h Form of seeking advices on metrology certification.
(2) Acceptance
A decision on acceptance or rejection of the application shall be made within 5 days from the date of receiving the application and a writing notice shall be issued.
(3) Review
Shanghai Bureau of Quality and Technical Supervision shall entrust an intermediary agency to arrange on-site review of the applicant within 2 months after accept the application.
(4) Ratification and Issuing Certificate:
Shanghai Bureau of Quality and Technical Supervision shall finish examination of the application and review materials within 20 working days. In case requirements for issuing the certificate are met, Shanghai Bureau of Quality and Technical Supervision shall issue the certificate to the applicant. In case requirements are not met, a writing notice shall be given to the applicant.

6 Time Limit
An administrative decision granting accreditation shall be made within 20 working days from the date of acceptance (excluding time for review). The Certificate of Metrology Certification shall be issued within 10 working days from the date of an administrative decision granting authorization is made.

7 Fee
According to Notice on printing and distributing of metrology charge standard of General Administration of Quality Supervision, Inspection and Quarantine, State Planning Commission and Ministry of finance (Issuance No 323 (1991) of AQSIQ), the fee for metrology certification is 1200 RMB per applicant and the fee of Certificate is 10 RMB. The applicant shall bear the charges for review which is not included in abovementioned fees.
